Terms of Service

These Terms of Service (“Terms”) govern your use of the Cognitiv Q application (the “Service”) provided by Stacked Stones Investments Pte. Ltd. (“Cognitiv Q”, “we”, “us”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. What Cognitiv Q is — and is not

Cognitiv Q is a cognitive-wellness tool. You complete short cognitive check-ins and see how your own results trend over time, along with wellness-framed content and suggestions. It is not a medical device and does not provide medical, diagnostic, or clinical services. It does not diagnose, treat, cure, or prevent any condition, and it is not a substitute for professional advice. If you have health concerns, consult a qualified healthcare professional. Results describe your own performance over time and are not compared against any clinical or population norm.

2. Eligibility and your account

  • You must be at least 18 and able to form a binding contract.
  • You are responsible for the accuracy of your account information and for keeping your login credentials secure.
  • You are responsible for activity under your account. Notify us at hello@cognitivq.com of any unauthorised use.

3. Acceptable use

You agree not to:

  • use the Service for any unlawful purpose or in breach of these Terms;
  • attempt to access accounts or data that are not yours, probe or bypass security or access controls, or disrupt the Service;
  • submit falsified or automated results, scrape, or reverse-engineer the Service except to the extent the law permits;
  • resell or commercially exploit the Service without our written permission.

We may suspend or terminate accounts that violate these Terms.

4. Your data

Your use of the Service involves processing your personal data as described in our Privacy Policy. You retain your rights in your data; you grant us the limited licence needed to operate the Service and, only if you opt in, to include de-identified data in anonymised group statistics. You can export or delete your data at any time from your account page.

5. Content and suggestions

Educational content and product suggestions are provided for general wellness information only, are not personalised medical or professional advice, and may reference third-party products we do not control. Any decision to use a supplement or product is yours; consult a professional where appropriate. We do not currently have affiliate or paid commercial relationships with the third-party products referenced.

6. Service availability and changes

We provide the Service on an “as is” and “as available” basis. We may modify, suspend, or discontinue features at any time, and we do not guarantee the Service will be uninterrupted or error-free. Optional or paid features, if introduced, may be governed by additional terms presented at the time.

7. Disclaimers

Cognitive check-in results are estimates subject to normal day-to-day variation and measurement noise; we do not warrant their accuracy for any particular purpose, and you should not rely on them as a health indicator.

Nothing in these Terms shall exclude, restrict, or modify — or purport to exclude, restrict, or modify — any condition, warranty, guarantee, right, or remedy implied by Singapore law (including the Consumer Protection (Fair Trading) Act and the Unfair Contract Terms Act) which cannot be lawfully excluded, restricted, or modified. Subject to these non-excludable rights, all other warranties, representations, or conditions, whether express or implied, are hereby excluded to the fullest extent permitted by law.

8. Limitation of liability

Except for any liability that cannot be excluded by law, including non-excludable guarantees implied under Singapore law, the Company’s liability for a breach of any such non-excludable condition or warranty is limited, at the Company’s sole option, to the re-supply of the services or the payment of the cost of having the services supplied again.

Subject to those non-excludable rights, and to the fullest extent permitted by law: (a) we will not be liable for any indirect, incidental, special, or consequential damages, or for any decision made in reliance on the Service; and (b) our total aggregate liability arising out of or in connection with the Service will not exceed USD $1,000.

9. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate access for breach of these Terms or where required by law. Provisions that by their nature should survive termination (e.g. disclaimers, limitation of liability) will survive.

10. Governing law and disputes

These Terms are governed by the laws of Singapore, and disputes are subject to the courts of Singapore, without prejudice to any mandatory consumer-protection rights in your place of residence.

11. Changes to these Terms

We may update these Terms from time to time. If changes are material, we will notify you. Continued use after changes take effect constitutes acceptance.
